1. Introduction and Acceptance
Welcome to Alba (hereinafter "Alba", "we", "our", or "us"). Alba is a geo-restricted social media platform designed for local communities, with a focus on reducing addictive usage patterns and fostering real-life social connection.
By downloading, installing, or using the Alba mobile application and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and Alba. Please read them carefully before creating an account.
2. Eligibility
To use Alba, you must:
- Be at least 18 years of age
- Be located in a geographic area where Alba operates
- Have the legal capacity to enter into a binding contract
- Not have been previously suspended or permanently banned from Alba
- Not be prohibited from using the Service under applicable law
By creating an account, you confirm that you meet all of the above eligibility requirements. If you are using Alba on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
3. Account Registration
To access most features of Alba, you must create an account. When registering, you agree to:
- Provide accurate, complete, and up-to-date information
- Use your real identity — no impersonation of other individuals or entities
- Keep your login credentials confidential and not share them with anyone
- Notify us immediately at support@albaappofficial.com if you suspect unauthorised access to your account
- Be responsible for all activity that occurs under your account
We reserve the right to refuse registration or suspend accounts that we reasonably believe violate these Terms or applicable law.
4. Geo-Restriction and Community Assignment
Alba is a location-based platform. By using the Service, you acknowledge and agree that:
- Your account will be assigned to a local community based on your verified geographic location
- You must grant location permissions to access geo-restricted features of the app
- Attempting to falsify, spoof, or circumvent location verification is strictly prohibited and may result in immediate account termination
- Your community assignment may change if you relocate, subject to available communities in your new area
- Alba may limit or restrict access to certain communities based on capacity, geographic boundaries, or other operational factors
5. User Content
5.1 Your Content. "User Content" means any text, photos, videos, audio, links, messages, or other material you post, upload, or share through the Service. You retain ownership of your User Content.
5.2 Licence to Alba. By posting User Content on Alba, you grant us a non-exclusive, royalty-free, worldwide, sublicensable licence to use, reproduce, modify, distribute, and display your content solely for the purposes of operating, improving, and promoting the Service. This licence ends when you delete your content or your account, except where your content has been shared by others.
5.3 Content Standards. You are solely responsible for your User Content. You agree not to post content that:
- Is unlawful, defamatory, harassing, threatening, abusive, or discriminatory
- Infringes any third party's intellectual property, privacy, or other rights
- Contains nudity, sexually explicit material, or graphic violence
- Promotes or facilitates illegal activity
- Contains misinformation, spam, or deliberately misleading content
- Involves the commercial promotion of products or services without our prior written approval
- Impersonates any person or entity
- Contains malware, viruses, or harmful code
5.4 Moderation. We reserve the right (but have no obligation) to review, remove, or restrict any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
6. Prohibited Conduct
In addition to the content standards above, you agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Use automated tools, bots, scrapers, or scripts to interact with the Service
- Attempt to gain unauthorised access to any part of the Service, other user accounts, or our backend systems
- Interfere with or disrupt the integrity or performance of the Service
- Collect or harvest personal data of other users without their consent
- Use the Service for commercial purposes without our prior written approval
- Circumvent, disable, or interfere with security features of the app
- Use Alba in any way that violates applicable local, national, or international law
7. Screen Time Features and Anti-Addiction Tools
Alba includes features designed to help you manage your usage, including session time limits, daily usage summaries, and scheduled logout reminders. You acknowledge that:
- These features are provided as tools to support healthy usage habits and are not a substitute for professional advice
- You are responsible for configuring and managing your own usage settings
- Alba does not guarantee that these tools will eliminate problematic usage patterns
- Usage data collected for these features is processed as described in our Privacy Policy
8. Premium Subscriptions and Payments
8.1 Free and Premium Tiers. Alba offers a free tier and optional premium subscription plans that unlock additional features, including but not limited to an ad-free experience and Traveler Mode.
8.2 Billing. Subscriptions are billed on a recurring basis (monthly or annually) through Apple App Store or Google Play Store. By subscribing, you authorise the relevant platform to charge your payment method on the applicable billing cycle.
8.3 Cancellation. You may cancel your subscription at any time through your Apple ID or Google account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods, except where required by applicable law.
8.4 Price Changes. We reserve the right to change subscription prices. We will give you at least 30 days' notice of any price increase, and continued use of the Service after the price change takes effect constitutes your acceptance.
8.5 Refunds. Refund requests are subject to the refund policies of the Apple App Store or Google Play Store, as applicable. To request a refund, please contact the respective platform directly.
9. Intellectual Property
All rights, title, and interest in and to the Service — including the Alba name, logo, design, software, features, and all related intellectual property — are and will remain the exclusive property of Alba and its licensors. Nothing in these Terms grants you any rights to use our trademarks, logos, or branding without our prior written consent.
You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.
10. Third-Party Services and Links
The Service may contain links to or integrations with third-party services (such as Apple Pay, Google Pay, or venue partner pages). These third-party services are governed by their own terms and privacy policies, and we are not responsible for their content, practices, or availability. Your use of any third-party service is at your own risk.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content available through the Service.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALBA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL ALBA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ALBA IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Alba and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.
14. Account Suspension and Termination
14.1 By You. You may delete your account at any time through the app settings. Upon deletion, your personal data will be processed as described in our Privacy Policy.
14.2 By Alba. We may suspend or permanently terminate your account, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or illegal activity, or if continued access poses a risk to the Service or other users.
14.3 Effect of Termination. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including sections on intellectual property, disclaimers, limitation of liability, and governing law.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. The courts of Milan, Italy shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
If you are a consumer resident in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
Before initiating any formal dispute, we encourage you to contact us at support@albaappofficial.com to attempt to resolve the matter informally.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
17. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to do so in the future.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alba regarding the Service and supersede all prior agreements, understandings, or representations relating to the same subject matter.
